For instance, to High Treason, or the adherence to the unsuccessful side in a competition for the Crown; to Homicide committed in revenge, on a sudden quarrel, or in the course of a duel, by consent: to Rape and other irregularities of the venereal appetite. This, however, seems to proceed not so much from design as from inattention in the authors of our Common Law; and is one of the many absurd and mischievous consequences that follow from the lumping together offenses of the most heterogeneous natures under the name of Felonies.
